The challenge:
We acted for a private offshore company that had initiated litigation against one of Australia’s largest and most well-respected companies. The defendant had both the resources and the litigation experience to mount a strong rebuttal to our client’s case.
Our client had no public profile in Australia and the litigation was extremely complex, making it a challenge to articulate the case in a relevant way to the Australian media.
fowlstone’s approach:
To overcome the complexity of the matter, we spent considerable time educating a small group of highly targeted journalists, including extensive briefings with the legal team and the client.
We used significant milestones in the litigation to generate media momentum in order to put maximum public pressure on the defendant.
We used topical industry thematics as a way of building greater impact around the case, garnering significant media attention.
Additionally, we used third-party endorsement to build credibility around our client’s claim, including direct engagement with analysts and commentators.
The results:
Following our sustained public campaign, the client achieved a successful commercial outcome. The build-up of pressure in the media was sufficient to negotiate a successful outcome, which had not been possible previously.
